This Privacy Policy (“Policy”) is provided by Pivotal Ventures LLC, Pivotal Philanthropies Foundation, and their related entities (collectively, “Pivotal” “we,” “us,” or “our”) to describe the personal information we collect, how we use it, with whom we share it, and the choices available regarding our use of the information. We also describe the measures we take to protect the security of your personal information and how to contact us about our privacy practices.

This Policy applies to our website, https://www.pivotal.com, together with any other website or online portal under our control that links to this Policy (collectively, the “Site”) and our related services, events, social media pages, and email and other electronic communications (collectively, and together with the Site, the “Services”).

1. CHANGES TO THIS POLICY

We reserve the right to change this Policy at any time, in our sole discretion. We will post changes to the Policy on this page and encourage you to review it each time you visit the Site to stay informed. In some cases, we may take additional steps to inform you of updates to this Policy, consistent with the significance of the changes we make or as may be required by applicable law. The updated Policy will be effective as of the “Last Updated” date indicated at the top of this Policy unless otherwise stated. Your use of the Services after the posting date of the updated version of this Policy will constitute your acknowledgement of such changes.

2. PERSONAL INFORMATION COLLECTION

A. Personal Information You May Provide

Based on your use of the Services, we may collect information from you directly. For example, in order to sign up for our newsletter, register an account with us, or participate in certain functionalities, promotions, or open calls for grants or awards, you may be asked to provide personal information. The types of personal information we may collect from you directly may include, for example:

  • Contact information, such as your first and last name, email address, postal address, zip code, and telephone number.
  • Professional information, such as your company’s or organization’s name, location, contact information, and other details about your company or organization.
  • Account information and other details you provide when creating an account on one of our user portals, such as your username, login details, and information that you store in your account.
  • Preferences, such as those you set in your account, if applicable, and any marketing or communications preferences.
  • Survey responses, such as the information you provide in response to our surveys or questionnaires.
  • Communications, such as the information associated with your requests or inquiries, including for support or assistance, and any feedback you provide when you communicate with us.

B. Personal Information We Automatically Collect

We, our service providers, and our advertising partners may collect personal information automatically when you visit or interact with the Services. This collection may include, but is not limited to: your domain name and host for Internet access, the Internet address of the site from which you came, your computer’s IP address and information about your computer or mobile device operating system type and version number, wireless carrier, manufacturer and model, browser type, and host, the date and time you access the Site and the pages you visit, and general location information such as city, state, or geographic area.

We collect this information in order to help diagnose problems with our server, administer the Site, help us understand user activity and patterns, facilitate online advertising, and other uses outlined in this Policy. We also use it to help identify you and to gather broad demographic information. We may automatically collect information using the following mechanisms:

  • Cookies, which are small text files that are stored on a computer for record-keeping purposes. We and our third-party analytics providers and advertising partners use cookies to record information about your activities on the Site and to “remember” you when you return to the Site. Some cookies remain until deleted; others, such as session ID cookies, expire when you close your browser. You may attempt to reject cookies via your browser settings and may still use the Site, however certain features may not be available if cookies are not accepted.   • Pixels (also known as web beacons, tags, or JavaScript), which are tiny graphics with unique identifiers, used to track online movements of web users. Unlike cookies, which are stored on your device—pixels are embedded invisibly on web pages or in HTML-based emails and are about the size of a period. Analytics and advertising partners may place pixels on the Site that monitor which websites you visit (both before and after visiting the Site). We may also use pixels to analyze your interaction with our email communications. Our partners use information from pixels to help us improve our business and Site and for the other purposes described in this Policy. We do not control the use of pixels by third parties.
  • Local storage, which is used to save data on a visitor’s device. We may use data from local storage to, for example, enable web navigation, store multimedia preferences, customize what we show you based on your past interactions, and remember your settings.
  • Session-replay technologies, which are third-party software programs that we may use on the Site to record a video replay of a user’s interactions. The replay may include clicks, mouse movements, scrolls, mobile app touches, typing, and other user activities. We use these replays for research and development purposes, such as troubleshooting Site issues, understanding how users interact with the Site, and identifying areas for improvement.

  • Chat technologies, such as chat windows or similar features that enable communication with us through the Site. If these technologies are present, our chat vendors and other third parties may access and use the device data and online activity data described above, and may monitor and record your chats, for the purposes described in this Policy. When you use these features, please note that you are not communicating with a human.

C. Personal Information from Third Parties

We use third parties, such as our service providers, advertising partners, and social media platforms, to help us operate and improve the Services. We may receive personal information about you from these third parties or from publicly available sources and may merge or combine such personal information with the personal information we collect from you directly or automatically.

We may use various analytics providers, including Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Site and report on activities and trends. This service may also collect information regarding the use of other websites, apps and online resources. 3. USE OF PERSONAL INFORMATION

We use the personal information we collect for the purposes described below or at the time of collection. We may also use the personal information we collect about you in other ways that we disclose to you at the time we collect it or before we begin using it for those other purposes.

A. To Provide Our Services

We use personal information to provide, operate, and deliver the Services. For example, personal information may be used to:

  • manage our relationship with you, including responding to your comments and questions;
  • personalize and improve our content and your overall experience with the Services;

We use personal information for business analytics purposes, including to conduct research to assess the effectiveness of our Services, marketing, and advertising, to analyze market trends and (future) user interests as well as analyze your interactions with our Services, and to develop new features, functionality, content, and services.

As part of these activities, we may create aggregated, de-identified, or other anonymous data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use aggregated or anonymized information and share it with third parties for any lawful purpose.

C. For Direct Marketing

We may send you Pivotal-related or other direct marketing communications as permitted by law, including materials, updates, information, opportunities, and promotional material from us and our business partners. D. For Interest-Based Advertising

We may work with third-party advertising companies and social media companies to help us advertise our business and to display ads for our Services. These companies may use cookies and similar technologies to collect information about you (including the information described above in “Personal Information We Automatically Collect”) over time across our Site and other websites and services or your interaction with our emails, and use that information to serve ads that they think will interest you. In addition, some of these companies may use hashed customer lists that we share with them to deliver ads to you and to similar users on their platforms. E. To Ensure the Security of Our Services

We use personal information for security purposes, including the detection, prevention, and investigation of attacks, and to protect against, identify, and prevent fraud and other crime, claims, or liabilities.

F. To Comply With Legal Obligations and Our Internal Policies

We use personal information for compliance purposes, including to defend or protect us, you, our customers, or third parties, from harm or in legal proceedings; enforce the terms and conditions that govern the Services; audit our internal processes for compliance with legal and contractual requirements and internal policies; respond to court orders, lawsuits, subpoenas, and government requests; and address legal and regulatory compliance.

In some cases, we may use your personal information in accordance with your prior direction or, in some cases, we may specifically ask you for your consent to collect, use, or share your personal information, such as when required by law.

4. PERSONAL INFORMATION RETENTION

We retain your personal information for as long as needed or permitted in light of the purposes for which it was obtained and consistent with applicable law. Such purposes include satisfying any legal, accounting, or reporting requirements, establishing and defending legal claims, preventing fraud, or as required to meet our legal obligations. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. We do not undertake any retention obligations through this statement.

5. HOW WE SHARE PERSONAL INFORMATION

In addition to the specific situations discussed elsewhere in this Policy or at the point of collection, Pivotal may share your personal information in the following contexts and with the following entities or persons.

A. Affiliated Entities

We may disclose personal information to our affiliated entities, subsidiaries, and other related organizations.

B. Service Providers

We share personal information with third-party agents and service providers. These third parties may include various business service providers or providers that supply support for the Site or Services or otherwise work directly with us for the operation of our business. For example, we work with service providers for website hosting, maintenance services, database management, analytics, fraud protection, marketing, customer relationship management, finances, and other purposes.

C. Campaign Partners

We may share your personal information with third party campaign partners (“Campaign Partners”). These third parties may include various non-profit organizations or other organizations whose goals and missions align with those of Pivotal. Campaign Partners may collect information such as your name, address, zip code, email address, or phone number. In some cases, the personal information you share with Campaign Partners may be publicly disclosed. Please review the notices, disclosures, and privacy policies of all Campaign Partners prior to sharing any information with them. We have no control over, and are not liable or responsible for the privacy practices, terms of use, or content of Campaign Partner sites. D. Advertising Partners

We also share personal information with third parties who we partner with for advertising campaigns or that collect information about your activity on the Site for the purposes described in the “For interest-based advertising” paragraph in the “Use of Personal Information” section above.

E. Professional Advisors

We may share personal information with persons, companies, or professional firms providing Pivotal with advice and consulting in accounting, administrative, legal, tax, financial, debt collection, and other matters, to the extent such information is necessary in their provision of services to Pivotal.

F. Legal Requirements

In some cases, we may share your information (1) as required by any applicable law or legal regulation; (2) if we believe disclosure is needed to protect our rights, property, or safety; (3) to government regulators or law enforcement authorities in connection with any judicial proceeding, court order, subpoena, or legal process served on us or the Site; and (4) to respond to a physical threat to you or another person.

G. Insolvency and Business Transitions

If we should ever file for bankruptcy or engage in a business transition such as a merger with another company, or if we purchase, sell, or reorganize all or part of our business or assets, we may disclose your information, including personal information, to prospective or actual purchasers in connection with one of these transactions.

6. INFORMATION SECURITY MEASURES

We employ appropriate administrative, technical, and physical safeguards designed to protect the personal information we collect. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Site.

Unfortunately, transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee its security. Any transmission of personal information is at your own risk.

7. YOUR CHOICES

A. “Do Not Track”

Some browsers offer a “Do Not Track” privacy preference. Generally, when a user turns on the “Do Not Track” signal, their browser sends a message to websites requesting that the user not be tracked. Please note: If you restrict, disable, or block any or all cookies from your browser, mobile, or other device, the Site and Services may not operate properly, and you may not have access to content available through the Site. We are not liable for any inability to use the Site or degraded functioning arising from settings and choices regarding cookies.

C. Interest-Based Advertising

You can limit the use of your information for interest-based advertising by blocking third-party cookies in your browser settings, using browser plug-ins/extensions, and/or using your mobile device settings to limit the use of the advertising ID associated with your mobile device. If you opt-out of interest-based advertisements, you will still see advertisements online but they may be less relevant to you.

D. Marketing Emails

You may opt-out of our marketing-related emails by selecting the “unsubscribe” link at the bottom of the email you received. You may still receive service-related communications, such as those about your account or to deliver notifications directly to you through the Services.

E. Review and Request Changes to Your Personal Information

If personal information that you have submitted to us changes or if you would like to remove your personal information, please contact us as provided at the end of this Policy. We will make good faith efforts to resolve such requests.

F. Text Messages

We may offer communications via text messages sent by Pivotal or any of our service providers, such as for customer service, account-related, or marketing purposes. To stop receiving text messages from us, reply STOP to any text message you receive from us. Note that we may send you a message to confirm receipt of your STOP request.

8. CHILDREN’S PRIVACY

The Services are not intended for use by anyone under the age of 18, and we do not knowingly collect personal information from children under 18.

9. NOTICE TO CALIFORNIA RESIDENTS (SHINE THE LIGHT LAW)

California Civil Code Section 1798.83 permits California residents to request, once a year and free of charge, a list of third parties to whom we have disclosed personal information (as defined by that statute) of that California resident for direct marketing purposes in the preceding calendar year, and the categories of such personal information disclosed to them. 10. NOTICE TO NEVADA RESIDENTS

Nevada Revised Statutes Chapter 603A allows Nevada residents to opt out of the “sale” of certain types of personal information. Subject to several exceptions, Nevada law defines “sale” as the exchange of certain types of personal information for monetary consideration to another person. If you are a Nevada resident and wish to exercise your “sale” opt out rights, you may submit a request to us using the contact information at the end of this Policy.

11. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

Pivotal is based in the United States, and we have service providers in the United States and potentially other countries. Your personal information may be collected, used, and stored in these locations or other places outside your home country. Privacy laws in these jurisdictions may not be as protective as those in your home country. By providing your personal information, where applicable law permits, you specifically and expressly consent to such transfer and processing and the collection, use, and disclosure as set out herein.

12. NOTICE TO INDIVIDUALS IN THE EEA, UK, AND SWITZERLAND

The information provided in this section applies only to individuals in the European Economic Area, United Kingdom, and Switzerland (collectively, “Europe”). Except as otherwise specified, references to “personal information” in this Policy are equivalent to “personal data” governed by European data protection legislation.

The Site and Services may contain links to other sites or online services (“Linked Sites”). We have no control over, and are not liable or responsible for, the privacy practices, terms of use, or content of Linked Sites. Linked Sites may collect personal information from you that is not subject to our control. The data collection practices of Linked Sites will be governed by that site’s privacy policy.
